POLICY of the Belarusian State Philharmonic Society regarding the Video Surveillance

1. GENERAL PROVISIONS

1.1. Approval of the Regulation on the Policy on Personal Data Processing (hereinafter – the Policy) is one of the measures taken by the Belarusian State Philharmonic Society to protect personal data as provided for by Article 17 of the Law of the Republic of Belarus No. 99-З of 7 May 2021 "On Personal Data Protection" (hereinafter – the Law).

1.2 The Policy explains to personal data subjects how and for what purposes their personal data are collected, used or otherwise processed, as well as reflects the rights of personal data subjects in this regard and the mechanism for their realisation.

The Policy does not apply to the processing of personal data in the course of employment, administrative procedures and video surveillance, as well as to the processing of cookies on the website of the Belarusian State Philharmonic Society.

1.4 This Policy uses terms and their definitions in the meaning defined by the Law.

1.5. The Belarusian State Philharmonic Society processes only those personal data that are necessary for the fulfilment of the stated purposes and does not allow their excessive processing.

2. PURPOSES, CATEGORIES OF PERSONAL DATA SUBJECTS WHOSE DATA ARE PROCESSED, LIST OF PROCESSED PERSONAL DATA, LEGAL GROUNDS AND TERMS OF PERSONAL DATA PROCESSING

Belarusian State Philharmonic Society processes personal data of personal data subjects for the purposes, in the scope, on legal grounds and within the time limits applicable to each category of personal data subjects according to Appendix 1 to this Policy.

3. AUTHORISED PERSONS. CROSS-BORDER TRANSFER OF PERSONAL DATA

3.1 The Belarusian State Philharmonic Society entrusts the processing of personal data to authorised persons.

The list of authorised persons processing personal data on behalf of the Belarusian State Philharmonic Society is contained in Appendix 2 to this Policy.

3.2 The Belarusian State Philharmonic performs cross-border transfer of personal data to ensure continuous communication with users of social networks and messengers (Instagram, TikTok, Telegram, YouTube video hosting).

Trans-border transfer of personal data to the territory of a foreign state may be carried out by the Belarusian State Philharmonic Society if:

3.2.1. in the territory of a foreign state an adequate level of protection of the rights of personal data subjects is ensured – without restrictions in the presence of legal grounds provided by the Law;

3.2.2. on the territory of a foreign state the adequate level of protection of the rights of personal data subjects is not ensured – in cases provided for by Article 9 of the Law, including:

  • when the consent of the personal data subject is given, provided that the personal data subject is informed of the risks arising from the lack of an adequate level of protection;
  • when placing information about its activities on the global computer network Internet;
  • when the processing of personal data is necessary for the fulfilment of the duties (powers) stipulated in the law of the Republic of Belarus.

4. RIGHTS OF PERSONAL DATA SUBJECTS

4.1 The subject of personal data has the right:

4.1.1. to withdraw his/her consent, if for the processing of personal data the Belarusian State Philharmonic Society has applied to the personal data subject for consent. The right to withdraw consent cannot be exercised if the processing is carried out on other legal grounds (for example, in accordance with legal requirements or on the basis of a contract);

4.1.2. to receive information regarding the processing of his/her personal data by the Belarusian State Philharmonic Society, which contains:

  • the location of the Belarusian State Philharmonic Society;
  • confirmation of the fact of processing of the personal data of the requested person by the Belarusian State Philharmonic Society;
  • personal data and the source of their obtaining
  • legal grounds and purposes of personal data processing;
  • the period for which consent is given (if personal data processing is carried out on the basis of consent);
  • name and location of the authorised person(s);
  • other information required by law;

4.1.3. request the Belarusian State Philharmonic Society to amend his/her personal data in case the personal data are incomplete, outdated or inaccurate. For this purpose, the personal data subject shall attach relevant documents and (or) duly certified copies thereof confirming the need to amend the personal data;
4.1.4. to receive information from the Belarusian State Philharmonic Society about the provision of his/her personal data processed by the Belarusian State Philharmonic Society to third parties once a calendar year free of charge, unless otherwise provided by the Law and other legislative acts;
4.1.5. to demand from the Belarusian State Philharmonic Society to stop processing of his/her personal data free of charge, including their deletion, if there are no grounds for processing of personal data provided for by the Law and other legislative acts;
4.1.6. to appeal against actions (inaction) and decisions of the Belarusian State Philharmonic Society that violate his/her rights in the processing of personal data in accordance with the procedure established by law.

4.2 In order to exercise his/her rights related to the processing of personal data by the Belarusian State Philharmonic Society, the personal data subject submits to the Belarusian State Philharmonic an application in writing to the postal address specified in subparagraph 1.3 of paragraph 1 of this Policy or via the state unified (integrated) republican information system of registration and processing of appeals of citizens and legal entities (https://обращения.бел), and in case of exercising the right to withdraw consent - in the form in which such an application is submitted.

Such statement shall contain:

  • surname, first name, patronymic (if any) of the personal data subject, address of his/her residence (place of stay);
  • date of birth of the personal data subject;
  • statement of the essence of the personal data subject's requirements;
  • identification number of the personal data subject, in the absence of such number - number of the personal data subject's identity document, if this information was indicated by the personal data subject when giving his/her consent or personal data processing is performed without the consent of the personal data subject;
  • personal signature (for a written application) or electronic digital signature (for an application in the form of an electronic document) of the personal data subject.

The Belarusian State Philharmonic Society does not consider applications of personal data subjects received by it by other means (e-mail, telephone, etc.).

4.3 For assistance in exercising the rights related to the processing of personal data by the Belarusian State Philharmonic Society, the personal data subject may contact the person responsible for internal control over the processing of personal data in the Belarusian State Philharmonic Society by sending a message to the e-mail address uristpd@philharmonic.by.
